Patente


Una patente confiere el derecho a una invención técnica y protege al titular contra falsificaciones. Una patente protege la propiedad intelectual del inventor, mientras que también fomenta la innovación técnica al forzar a otros desarrolladores a investigar invenciones alternativas.

Existen dos tipos diferentes de patentes:

Patentes de productos (patentes de sustancias, materiales, dispositivos y acomodo)

Patentes de proceso (procesos de fabricación y de trabajo)

Para obtener una patente, los productos o procesos deben poder ser patentados. Eso significa que la invención debe ser nueva, comercialmente viable y estar basada en una actividad inventiva. Si este no es el caso, la compañía o la persona pueden solicitar un modelo de utilidad.

Las solicitudes de patentes se presentan en la oficina de patentes y las patentes se otorgan por 20 años, como máximo. Mientras la patente esté en vigor, el titular cuenta con derechos exclusivos para su uso y el derecho para emitir licencias.

Durch ein Patent wird ein Recht auf eine technische Erfindung erworben, die den Inhaber des Patents gegen Nachahmung schützt. Damit soll das geistige Eigentum des Erfinders geschützt werden. Zudem soll die technische Innovation gefördert werden, indem andere Entwickler zu Substitutionserfindungen ermuntert werden.

Unterschieden werden zwei Patentkategorien:

  • Erzeugnispatente (Sach-, Stoff-, Vorrichtungs- und Anordnungspatente)
  • Verfahrenspatente (Herstellungs- und Arbeitsverfahren)

Um ein Patent erwerben zu können, müssen Produkte oder Verfahren patentfähig sein. Dazu muss die Erfindung neu und gewerblich nutzbar sein und auf erfinderischer Tätigkeit beruhen. Ist dies nicht der Fall, kann ein Gebrauchsmuster beantragt werden.

Ein Patentschutz wird beim Patentamt beantragt und im Patentverfahren längstens für 20 Jahre erteilt. Während der Schutzzeit hat der Inhaber das alleinige Nutzungsrecht sowie das Recht zur Lizenzvergabe.

There are two different types of patent:

  • Product patents (substance, material, device and arrangement patents)
  • Process patents (manufacturing and working processes)

To acquire a patent, products or processes need to patentable. That means the invention must be new, commercially viable and based on inventive activity. If this is not the case, the company or individual can apply for a Utility model.

Patent applications are submitted to the Patent Office and patents are granted for no more than 20 years. While the patent applies, the holder has exclusive rights of use and the right to issue licences.
