实用新型
实用新型，是保护一个产品或工艺的法律手段，与专利类似，但对“独创性”的要求没专利那么严格。被授予的实用新型、要保护的产品或工艺必须基于“独创性”且在商业上是可行的。
获取实用新型保护比获取专利保护所需的费用更低，时间更短，因为产品的新颖性和所含的发明比例在注册之前都不需要审查。实用新型保护授予持有者多达 10 年（在德国）的使用此发明以及颁发制造许可证的权利。
实用新型保护的权利与专利一样全面，但对其授予条件可在随后进行复核，错授的实用新型还可以被撤回。
Gebrauchsmuster
Das Gebrauchsmuster ist ein rechtlicher Produkt- oder Verfahrensschutz, der einem Patent ähnlich ist. Im Gegensatz zu diesem sind die Anforderungen an die Erfindungshöhe weniger hoch. Das Gebrauchsmuster setzt voraus, dass das zu schützende Produkt oder Verfahren auf einem erfinderischen Schritt beruht und gewerblich nutzbar ist.
Gebrauchsmusterschutz kann kostengünstiger und schneller als ein Patentschutz erworben werden, weil bei der Eintragung in die Gebrauchsmusterrolle weder die Neuheit eines Produktes noch der Anteil der Erfindung überprüft wird. Der Schutz gewährt dem Inhaber für bis zu zehn Jahre das Recht, die Erfindung zu nutzen und Herstellungslizenzen zu vergeben.
Das Schutzrecht ist ebenso vollständig wie bei einem Patent. Allerdings können die Voraussetzungen für seinen Erwerb nachträglich überprüft und ein zu Unrecht erworbenes Gebrauchsmusterschutzrecht gelöscht werden.
Utility model
A utility model is a legal means of protecting a product or process and is similar to a Patent. However, compared to a patent, the requirements for 'inventive step' are less stringent. For a utility model to be granted, the product or process to be protected must be based on an 'inventive step' and be commercially viable.
Utility model protection can be cheaper and quicker to obtain than patent protection because neither the novelty of the product nor the proportion of the invention are examined prior to registration. This protection grants the holder the right to use the invention and issue manufacturing licences for up to ten years (in Germany).
The right of protection is as comprehensive as a patent. However, the conditions for its granting can be subsequently reviewed and a utility model that has been wrongly granted can be rescinded.
